Chef Jobs (ABN 59 534 385 866) operates a website portal that facilitates interaction between individual properties (advertisers) and job-seekers. Potential properties/employers (advertisers) provide information on themselves & their product which job-seekers can view, forwarding their resume or contact details if they choose to.

Copyright in the material and trademarks on the Site are owned by Chef Jobs unless otherwise indicated. You agree not to infringe any intellectual property rights of Chef Jobs.

 

BASIC WEB SITE RULES

You agree as a fundamental condition of using our Site and the Service that:

• you will only use this Service for the provision of, or access to information about perspective work in an establishment if you are an applicant or about your establishment if you are an employer (the Permitted Purposes);
  
  
• the purpose of Chef Jobs is to establish - a property’s specific information on the front page and the properties kitchen specific information on the second page, with the ability to advertise multiple positions within that single ad. Phone numbers, email addresses and website addresses are not permitted to be on these two pages. This site also allows you to place multiple ads (chains only); with resumes referring back to an individual (one) email address, but at no time is a property or organisation to use this site without property specific information. This web site is not designed for open ended ads with no specific information on an individual property just in the aid to collect resumes.
  
  
• Chef Jobs has provided this advertising / email facility in order to facilitate interaction between jobseekers and employers directly and must not be used for any other purpose. “No” third party usage, the property must advertise directly not through a third party such as (not limited to) a recruitment agency, immigration agency or other.
  
  
• Chef Jobs has provided this email facility in order to facilitate interaction between jobseekers and employers directly and must not be used for any other purpose. “No” third party usage, the jobseeker must apply directly not through a third party such as (not limited to) a friend, a recruitment agency, immigration agency or other.
  
  
• Chef Jobs is set up at present for the sole use of individuals / chefs to forward their information directly to an active advertiser.  It is not set up for a third party to act on behalf of an individual / chef, a third party is (but not limited to) a friend, recruitment agency, immigration agency, etc.  Use / assistance of a third party contravene the terms and conditions of chef jobs and will not be tolerated.  This will equate to misleading conduct and we reserve our right with this illegal contact, and will not stop from legal proceedings as required.
  
  
• An email address maybe blocked for any one or all of the following reasons: You are applying for positions that you are not qualified to apply for; You are applying for a position that is not being advertised; You currently do not have commercial kitchen experience; You do not have a current permanent work visa for Australia or New Zealand; You do not understand the usage of the web site; You are not a candidate or an employer - Chef Jobs has provided this advertising / email facility in order to facilitate interaction between jobseekers and employers directly and must not be used for any other purpose. “No” third party usage; such as (not limited to) a friend, recruitment agency, immigration agency or other.
  
  Chef Jobs has provided this email facility in order to facilitate interaction between trade qualified chef (jobseekers) genuinely looking to continue their kitchen career and future employers.  This site must not be used for any other purpose. 
  
  
• if you are not located in Australia you agree that you will not use any personal information collected by you from this Site in a manner that is not consistent with the requirements of Australia 's National Privacy Principles. You can obtain these from the Privacy Commissioner's web site at www.privacy.gov.au

• you will not use the Service in any way that constitutes any form of harassment or offensive behaviour, including but not limited to distributing or publishing communications, pictures, videos or audio recordings which contain libelous, slanderous, abusive or defamatory statements, or racist, pornographic, obscene, or offensive language or images;

• you will not forward chain letters through the Service;

• You will not use the Service in a way that infringes the privacy rights, property rights, or any other rights of any person including Chef Jobs;

• You will not publish or distribute through the Site messages, pictures or recordings or use the Service in any way which violates, plagiarises or infringes upon the rights of any third party, including but not limited to any copyright or trade-mark law, privacy or other personal or proprietary rights, or is fraudulent or otherwise unlawful or violates any law

• You will not use the Service to distribute, promote or otherwise publish any material containing any solicitation for funds, advertising or solicitation for goods or services.
  
  
• You will not use the Service to distribute or up load any virus, trojan horses or do anything else that might cause harm to the Service, Chef Jobs systems or to other users systems in any way.
  
  
• As a condition of using any services supplied by Chef Jobs, Advertisers must comply with the Human Rights and Equal Opportunity Commission Act 1986 (C'th) and all anti-discrimination and equal opportunity legislation applicable in the State or Territory in which they conduct business. Where an exemption to comply with the legislation has been granted, the exemption number must be included in the advertisement posted on Chef Jobs.
  
  
• Advertisers acknowledge and agree that Chef Jobs acts as a portal through which individuals seek employment opportunities and that Chef Jobs does not vet nor is it responsible for vetting job candidates or the representations (whether oral or in writing) made by them. Chef Jobs disclaims all liability for any loss, costs, damages or loss of profits sustained as a consequence of any Advertiser employing or engaging any person sourced through the Chef Jobs Site.

FEES AND PAYMENTS

• This site is free to jobseekers unless they choose to pay for access to the relevant 'paid facilities' of the site.

• From time to time Chef Jobs may offer a "Free Trial Period", if this is the case it is only valid for new members joining while the offer is available (if available it will be stated on the home page). This offer can only be take once by members NOT multiple times, if a member attempts to use the "Free Trial Period" more than once, the new ad that is created will be deactivated and the old ad re-activated. If a member has misplaced their username and password they are to contact Chef Jobs for assistance.

• Property listing & product information Is free to advertisers on Option 2 with charges levied once a job seeker initiate’s contact, this is considered as casual advertising paying on activity of your advertisement, being billed at the end of each month.

• Property listing & product information is charged to advertisers on Option 1 with NO charges levied once a job seeker initiate’s contact this is unlimited per month and is considered as subscription/permanent advertising.  Committing to a six (6) month contract with two options, pay for the six months up front or pay for the six months monthly this is your choice with two different cost structures.  You will receive an automated email coming close to the end of the six months, which you will need to read and action.  Failure to take action with this email will also be considered as acceptance to continue your current advertising and current payment option/plan with Chef Jobs for an additional six (6) months.

• Resume Service option is an additional paid service to our clients, which will assist in gathering all resumes sent to the property in one central location within their login area.  This is an option for continuous periods at present six (6) months, if this option is selected a tax invoice will be issued for the six (6) month period.   You will receive an automated email coming close to the end of the six months, which you will need to read and action.  Failure to take action with this email will also be considered as acceptance to continue your current resume collection service and payment with Chef Jobs for an additional six (6) months.

• Up to-date Fees are available on the Advertisers page of the Chef Jobs website and are subject to change without notice.

• All amounts owing to Chef Jobs by Advertisers must be paid within 14 days of the date of invoice notwithstanding any errors or omissions in any advertisement placed on the Chef Jobs Site. Chef Jobs may charge Advertisers interest on late payment at the rate of 12.5% per annum.

• It is the responsibility of all properties that join and advertise who incur fees to obtain authorities as required by your establishment. It is not the responsibility of Chef Jobs to obtain purchase orders or further authorisation, by you (the person joining chef jobs on behalf of your property / organisation / company) to take full responsibility. If an employee that had joined chef jobs leaves the establishment / property / organisation / company this does not make the fees incurred null and void, they are still to be paid within the agreed time frame or incur a penalty as above. Any debt collection fees incurred chasing outstanding fees will be borne by the client not chef jobs and will be billed accordingly.

• We use state of the art tracking software, to ensure your billing is correct and is available in your log in area on a daily basis. The tax invoice will have sufficient information on it to verify and validate emails received. It is not the responsibility for Chef Jobs to follow up advertisers if they have changed their email address or other details, it is the responsibility of the advertiser to keep their information current at all times to ensure that they receive all correspondence. Correspondence not received due to information not being updated or due to company firewalls is not the responsibility of Chef Jobs.

• With Chef Jobs there are no fixed contracts however by not deactivating your ad within the given trial-period (where applicable) is also considered as acceptance of the terms and conditions of this agreement between both parties, therefore charges will apply.

• Once you have listed your property, your advertisement will remain active until such time as you elect to deactivate or remove yourself from the site

SUSPENSION OR EXCLUSION
Chef Jobs reserves its right to suspend or exclude you from using the Service and/or the Site if you breach any of these terms and conditions, including, without limitation, if you fail to comply with the Basic Web Site Rules listed above, fail to pay any fees or payments that you owe, fail to respect the privacy of another user of the Service and/or the Site and/or use the Service and/or the Site other than for the Permitted Purposes.

 

INFORMATION FOR PERSONAL, NON COMMERCIAL USE ONLY
You agree that information contained on the Site is to be used for the Permitted Purposes. You may not modify, copy, reproduce, republish, upload, post, transmit or distribute in any way any material from the Site including code and software. You must not use the Site for any purpose that is unlawful or prohibited by these terms and conditions.

Chef Jobs provides no warranty to you that the services generally available through the Site will be uninterrupted or error-free or that defects in the service will be corrected. You also understand that Chefs Jobs cannot and does not guarantee or warrant to you that files available for downloading through the Site or delivered via electronic mail through the Site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.

YOUR RESPONSIBILITY FOR YOUR PASSWORD AND LOGIN
To become a registered advertiser, you must provide a password and a login name. You are entirely responsible if you do not maintain the confidentiality of your password and login name. Furthermore, you are entirely responsible for any and all activities that occur under your login name. You may change your password or login at any time by following instructions; you may also delete services attached to your registration at your convenience.

You agree to immediately notify Chef Jobs of any unauthorised use of your login name or any other breach of security or privacy known to you.

 

NO MISREPRESENTATIONS ALLOWED
You agree that it is a condition on your use of the Chef Jobs website and of any other services provided by Chef Jobs or through the Site that you will not through any act mislead or deceive others.

 

GENERAL PROVISIONS
If any part of these terms and conditions is held invalid that part shall be severed from these terms and conditions and the remainder of these terms and conditions will continue to be valid and enforceable. Termination of these terms and conditions will not end those provisions that are capable of surviving the ending of these terms and conditions. The laws governing these terms and conditions will be the laws in Queensland and you irrevocably submit to the exclusive jurisdiction of the courts exercising jurisdiction in that state.
For the purposes of this agreement the words:
(a) 'Chef Jobs', 'We', 'Our' and 'Us' refer to Chef Jobs; and

(b) 'Site' to materials delivered on www.chefjobs.com.au and other co-branded versions of the site.
